Happy Little Monsters – Returns, Refunds & Exchanges Policy

Last Updated: 16 August 2026

At Happy Little Monsters, we want every customer to be happy with their purchase. This Returns, Refunds & Exchanges Policy applies to purchases made through our online store and is intended to operate in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Nothing in this policy is intended to remove, restrict or waive any consumer right that cannot legally be excluded.

1. Seven-Day Change-of-Mind Returns

For qualifying online purchases, customers have a 7-day cooling-off period from the date they receive the goods, in accordance with section 44 of ECTA.

A customer may cancel the transaction within this period without providing a reason.

Where a customer exercises this statutory cooling-off right:

  • The customer must notify Happy Little Monsters of the cancellation within the applicable 7-day period.
  • The customer must return the product to Happy Little Monsters.
  • The customer is responsible for the direct cost of returning the product, as permitted by ECTA.
  • The product should be returned with all accessories, components, manuals, instructions and other items supplied with the product.
  • Wherever reasonably possible, the product should be returned in its original packaging.
  • Customers should not use, damage, modify or alter the product before returning it.

Where the law permits Happy Little Monsters to inspect the returned goods, we may do so to verify the return.

Important: The conditions concerning unused products, original packaging and included components apply to our voluntary change-of-mind return requirements only to the extent permitted by law and do not override any statutory consumer right.

Where section 44 of ECTA applies, Happy Little Monsters will process the refund in accordance with the statutory requirements. ECTA provides that the only charge that may be levied on the consumer for exercising this right is the direct cost of returning the goods.

2. Condition of Products for Voluntary Returns

Where a return is requested outside a statutory right, or where Happy Little Monsters voluntarily offers a return or exchange beyond what the law requires, the following conditions apply:

The product must be:

  • unused;
  • undamaged;
  • in its original condition;
  • returned with all parts, accessories and components;
  • returned with manuals, instructions and other supplied materials; and
  • returned in its original packaging, with the packaging intact and reasonably suitable for resale.

We reserve the right to refuse a voluntary return where these requirements have not been met, subject always to any rights the customer has under South African law.

3. Defective, Unsafe or Poor-Quality Products

Happy Little Monsters takes product safety and quality seriously.

Our products are supplied with the applicable manufacturer's instructions, safety information and age recommendations where these are provided with the product.

Customers must read and follow all instructions, warnings, age recommendations and safety information supplied with each product before allowing a child to use it.

Parents, guardians and caregivers are responsible for ensuring that products are used appropriately and, where applicable, that children are adequately supervised.

Where a product is damaged through misuse, negligence, incorrect assembly, failure to follow instructions, unauthorised modification, accident, abnormal use or ordinary wear and tear, Happy Little Monsters will not be responsible for that damage to the extent permitted by South African law.

However, nothing in this policy excludes or limits any statutory consumer rights relating to defective, unsafe or poor-quality goods.

Under section 56 of the CPA, qualifying goods carry an implied warranty of quality, and where goods fail to satisfy the applicable requirements within six months after delivery, the consumer may have statutory rights to return the goods and require repair, replacement or refund as provided by the CPA.

4. Product Safety and Manufacturer Instructions

Happy Little Monsters sells products supplied for the South African market and provides customers with the product information, instructions and warnings supplied with the goods where applicable.

Customers agree to use products in accordance with the manufacturer's instructions, safety warnings and recommended age requirements.

Happy Little Monsters will not be responsible, to the extent permitted by law, for injury, damage or loss resulting from:

  • failure to follow supplied instructions or safety warnings;
  • use of a product outside its intended purpose;
  • use by children outside the manufacturer's recommended age range;
  • improper assembly;
  • unauthorised modification or repair;
  • misuse or negligent use;
  • failure to supervise children where supervision is reasonably required; or
  • normal wear and tear.

Nothing in this section excludes liability or consumer rights that South African law does not permit a supplier to exclude.

5. Incorrect or Damaged Orders

If you receive the wrong product, a product that is materially different from what you ordered, or a product that arrived damaged, please contact us as soon as reasonably possible.

Please provide:

  • your order number;
  • a description of the problem; and
  • photographs or video showing the product and packaging where applicable.

We will assess the matter and provide the remedy required by applicable South African law.

6. Missing Parts or Accessories

If an item is delivered without parts or accessories that were advertised or included with the purchase, please contact us as soon as possible.

We may request photographs, videos or other reasonable information to help us investigate the issue.

Where the missing component constitutes a defect or failure to comply with the agreement, the customer's statutory rights will apply.

7. Refunds

Where a refund is approved or required by law, the refund will generally be made using the original payment method where reasonably possible.

Where ECTA's statutory cooling-off provisions apply, the applicable refund will be processed in accordance with ECTA.

Where another statutory consumer remedy applies, the applicable statutory timeframe and remedy will take precedence over this policy.

Refund Processing: Once the returned item has been received by Happy Little Monsters, approved refunds will be processed within 10 business days. Refunds will generally be made to the original payment method used for the purchase. Where applicable South African law requires a refund to be processed within a shorter period, the applicable statutory period will take precedence.

8. Return Shipping

For a qualifying statutory ECTA cooling-off return, the customer is responsible only for the direct cost of returning the goods, as provided by ECTA.

Where a product is defective, unsafe, incorrectly supplied or otherwise qualifies for a return at the supplier's expense under applicable law, Happy Little Monsters will bear the applicable return costs as required by law.

For voluntary returns that are not required by law, the customer may be responsible for the return shipping costs.

9. Products Damaged Through Misuse

Happy Little Monsters cannot accept responsibility for damage caused after delivery through misuse, abuse, accidents, incorrect assembly, failure to follow instructions, unauthorised modifications, negligence or ordinary wear and tear, to the extent permitted by law.

For example, where an RC toy is operated in a manner contrary to its instructions or is exposed to conditions outside its specified use, any resulting damage may not constitute a manufacturing defect.

This provision does not remove any statutory rights that may apply.

10. Manufacturer Warranties

Some products may carry an additional manufacturer's warranty.

Where a manufacturer's warranty exists, the customer should retain the original documentation and follow the applicable warranty procedure.

A manufacturer's warranty is additional to, and does not replace, any mandatory consumer rights provided by South African law.

11. Proof of Purchase

Happy Little Monsters may request reasonable proof of purchase, such as an order number, invoice or payment confirmation.

We will not impose unreasonable requirements that prevent a customer from exercising a statutory consumer right.

12. Returns Procedure

Before sending a product back, please contact Happy Little Monsters using our customer-service details.

Please provide:

  • Full name
  • Order number
  • Product purchased
  • Date of purchase
  • Reason for the return
  • Photographs or video where relevant

We will provide the applicable return instructions.

Customers should package returned products securely to prevent damage during transportation.

13. Our Liability

Happy Little Monsters will comply with all applicable South African laws and consumer-protection requirements.

Nothing in this policy is intended to exclude liability or consumer rights that cannot legally be excluded.

Subject to applicable law, Happy Little Monsters will not be liable for loss, damage, injury or claims arising from the misuse, negligent use, unauthorised modification, improper assembly or failure to follow the manufacturer's instructions or safety warnings supplied with a product.

Where a claim arises from a defective or unsafe product and the CPA or another applicable law provides the consumer with a remedy, that statutory remedy will apply.

14. South African Law

All purchases from Happy Little Monsters are subject to applicable laws of the Republic of South Africa.

This policy is intended to be interpreted consistently with applicable South African consumer-protection legislation.

If any provision of this policy is found to be unlawful or unenforceable, that provision will be severed or limited to the extent necessary, and the remaining provisions will continue to apply.
